The Supreme Court Agrees to Hear Trump's 14th Amendment Case
The Colorado Supreme Court is about to get its comeuppance
On December 19, 2023, the Colorado Supreme Court rendered a ludicrous opinion disqualifying President Trump from the Colorado GOP Presidential Primary ballot based on Article 3 of the 14th Amendment to the United States Constitution. President Trump’s legal team filed a Petition for Writ of Certiorari with the United States Supreme Court on Wednesday, January 3, 2024. A link to the actual Petition filed by Trump’s legal team is here if anyone wants to read it. A Writ of Certiorari is a request to the Supreme Court asking it to order up the record from a lower court and correct an error. The grant of such a writ is discretionary, meaning, the Supreme Court hears the cases it chooses to hear. Normally, the chances of getting such a writ granted are very low. According to the Supreme Court it agrees to hear 100-150 such cases per year out of 7,000 requests. Here is a blurb from the Court about this issue:
As I stated, President Trump’s team filed their Petition for Writ of Certiorari on Wednesday, January 3, 2024. On Friday, January 5, 2024, the Supreme Court agreed to hear the case. Here is a screenshot of the Court’s Order:
Readers will note the Court set a very aggressive schedule. The case is set for oral argument on February 8, 2024. The message is clear that the Court considers this a matter of great national importance and it intends to settle the matter forthwith. In the 27 years I practiced law, I don’t recall the United States Supreme Court granting a civil writ application within 48 hours of the writ being filed.
The fact the Supreme Court grants such a writ and agrees to hear the case does not necessarily mean the Court intends to reverse the lower court, though that result is more often than not the case. One analysis of the Supreme Court’s decisions on civil writ applications since 2007 showed the Court reversed the lower courts 71% of the time. Therefore, the odds are in Trump’s favor. Given the Court’s swift agreement to hear the case, the oddball nonsense from the Colorado court in the first place and the quick turnaround planned by the Supreme Court, the odds are OVERWHELMINGLY in President Trump’s favor that SCOTUS rules his way and slaps down the Colorado Supreme Court.
I believe the United States Supreme Court is going to reverse the Colorado Supreme Court’s idiotic decision and put an end to the efforts to kick President Trump off the ballot. Mark down what I said. If I am wrong, I will own it. (But, I am not wrong.)
